Terms of Service
1. Service Description
PhoneClock.In ("we," "our," or "us") provides a cloud-based time tracking and Electronic Visit Verification (EVV) platform designed for homecare agencies and caregivers (the "Service"). The Service enables employees and caregivers to clock in and out, track work hours, capture GPS-verified location data, manage schedules, and generate compliance reports through our web application and mobile apps.
2. Account Responsibilities
Accounts are created by organization administrators on behalf of their employees and caregivers. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify your administrator or contact us immediately if you become aware of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.
3. Acceptable Use
The Service is intended for legitimate business use by homecare agencies and their authorized personnel. You agree not to:
- Falsify time records, clock-in/out data, or any other information submitted through the Service.
- Attempt to gain unauthorized access to any part of the Service, other accounts, or related systems.
- Use the Service for any illegal purpose or in violation of any applicable laws or regulations.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Share your login credentials with any other person.
4. GPS and Location Tracking
By using the Service for clock-in and clock-out functionality, you consent to the collection of your GPS location data (latitude, longitude, and accuracy) at the time of each clock event. This location data is required for Electronic Visit Verification (EVV) compliance as mandated by applicable healthcare regulations. Location data is only captured at the moment of clock-in and clock-out events and is not continuously tracked. If you do not consent to location tracking, you may not be able to use the clock-in/out features of the Service.
5. Data Accuracy and Digital Signatures
You are responsible for the accuracy of all time entries and information you submit through the Service. Digital signatures captured during clock-in and clock-out events are considered legally binding acknowledgments of the time and location recorded. You agree that your electronic signature carries the same legal weight as a handwritten signature for the purposes of time verification and EVV compliance.
6. Intellectual Property
The Service, including all software, design, text, graphics, logos, and other content, is the exclusive property of PhoneClock.In and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
7. Limitation of Liability
To the maximum extent permitted by applicable law, PhoneClock.In and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the Service, whether based on warranty, contract, tort, or any other legal theory. Our total liability for any claims arising under these Terms shall not exceed the amount you or your organization paid us in the twelve (12) months preceding the claim.
8. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we reasonably believe you have violated these Terms or if your organization's subscription is terminated. Upon termination, your right to access the Service will cease immediately. You may also request deletion of your account through the self-service account deletion feature or by contacting us directly.
9. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
